1. Gym Rules and Code of Conduct

To create a safe, supportive, and enjoyable environment, all members agree to the following rules and code of conduct while using the facilities.

1.1 Facility Rules

  • Use of Equipment: Members are expected to use all equipment responsibly and only for its intended purpose. If unsure about how to use a piece of equipment, members must seek assistance from gym staff.

  • Respect of Property: Members are required to handle all equipment with care. After use, weights and equipment should be returned to their designated areas. Damage to equipment due to negligence may result in reimbursement to Montreal Powerhouse or suspension of membership.

  • Cleanliness: Members should wipe down equipment after use, dispose of any trash in designated bins, and ensure all personal items are stored in lockers. Members are expected to keep the workout area clean when bringing food & drinks into the workout area.

  • Dress Code: Members are required to wear appropriate athletic attire.

  • Guest Policy: Only registered guests who have signed a liability waiver may use the gym facilities, provided the member has followed proper guest check-in procedures.

  • Parking: The parking zone has dedicated spots for gym members. If the spots are full, members must park in public street spaces.

1.2 Behavioral Expectations

  • Respect of Others: Members are expected to treat staff and fellow members with respect at all times. This includes maintaining courteous language and refraining from behaviors that may disrupt others’ workouts.

  • Prohibited Behaviors: Aggressive behavior, harassment, discrimination, or any form of intimidation towards other members or staff will not be tolerated and may lead to immediate termination of membership without refund.

  • Mobile Device Use: Phone calls should be limited to non-workout areas to avoid disturbing others. Photography and video recording are prohibited without prior permission from both gym staff and any individuals in the frame.

  • Drug-Free Environment: The gym has a zero-tolerance policy for drugs and alcohol. Members must refrain from using or bringing any illegal substances onto the premises.

1.3 Violation of Rules

  • Consequences: Failure to adhere to any of the above rules may result in a warning, suspension, or termination of membership. The gym reserves the right to terminate any membership without refund for serious or repeated infractions.

1.4 Reporting Issues

Members are encouraged to report any unsafe conditions, incidents, or violations of these rules to gym staff or via e-mail at info@montrealpowerhouse.com. Prompt reporting helps ensure a safe and enjoyable environment for all.

1.5 Age Requirement

All members must be at least 18 years of age to join Montreal Powerhouse independently. Minors aged 16 and 17 may also become members with the written consent of a parent or legal guardian who will assume responsibility for the minor's adherence to all gym rules, terms, and policies. Minors under the age of 16 may become members if they are accompanied at all times by a parent or legal guardian who will assume responsibility for the minor's adherence to all gym rules, terms, and policies.

1.6 Key Fob Replacement and Return Fee

Members under annual and monthly memberships are provided with a key fob for 24/7 access to the gym. In the event that a member loses or damages their key fob, a $25 replacement fee will be charged. This fee also applies if a member does not return the key fob upon ending their membership.


2. Liability Waiver

2.1 Assumption of Risk

The undersigned member (hereafter referred to as "Member") acknowledges that powerlifting, strength training, and other fitness activities involve inherent risks, including but not limited to ligament sprains or tears, muscle strains or tears, dislocations, fractures, and other serious injuries. By signing this agreement, the Member voluntarily assumes full responsibility for any risks, injuries, or damages that may occur as a result of participating in gym activities, using gym equipment, or engaging in fitness training at Montreal Powerhouse.

2.2 Release of Liability

The Member agrees to release and hold harmless Montreal Powerhouse, its owners, employees, trainers, agents, and representatives (collectively "Released Parties") from any liability, claims, or actions of any kind arising from personal injury, illness, or property loss, regardless of whether such injury or damage is caused by the negligence of the Released Parties, or otherwise, to the fullest extent permitted by law.

2.3 Medical Clearance

The Member certifies that they have consulted with a licensed physician or qualified health professional and have no medical conditions or physical limitations that would prevent them from safely participating in gym activities. The Member further agrees to cease any activity if they feel discomfort, dizziness, or any symptoms that could indicate potential injury or health concerns.

2.4 Responsibility for Health and Safety

The Member agrees to observe all gym rules, including but not limited to safe lifting techniques, proper use of equipment, and adherence to any posted guidelines or instructions provided by gym staff. The Member assumes responsibility for their health, safety, and general well-being during all activities at Montreal Powerhouse.

2.5 Emergency Medical Treatment

In the event of an emergency, the Member authorizes Montreal Powerhouse to seek medical treatment on their behalf if deemed necessary. The Member acknowledges that they are financially responsible for any medical treatment required due to injury or illness while on gym premises.

2.6 Indemnification

The Member agrees to indemnify and hold harmless Montreal Powerhouse and the Released Parties from any claims, damages, losses, or legal fees arising from actions or behavior by the Member that result in injury to themselves or others.

2.7 Acknowledgment of Understanding

The Member confirms that they have read, fully understand, and voluntarily agree to the terms of this Liability Waiver. The Member understands that they are waiving certain legal rights, including the right to sue, by signing this agreement.

3. Health and Safety Policies

To promote a safe and supportive environment, all members agree to follow these health and safety guidelines while using Montreal Powerhouse facilities.

3.1 Emergency Procedures

  • In Case of Injury: Members must immediately report any injuries to gym staff, regardless of the severity. First-aid kits are available on-site for minor injuries.

  • Evacuation Protocol: Members are required to follow any instructions provided by gym staff during emergency evacuations or drills. Emergency exits are clearly marked and must remain accessible at all times.

3.2 Personal Belongings

  • Changing Room Storage Space Use: Storage space is provided in the changing room and must be emptied at the end of each visit. Montreal Powerhouse is not responsible for any items left overnight, and unclaimed items may be removed periodically.

  • Lost and Found: Any items found on the premises will be kept in the gym's Lost and Found area for up to 2 weeks. After this period, unclaimed items may be donated or disposed of.

3.3 Hygiene and Cleanliness

  • Sanitizing Equipment: Members are expected to wipe down equipment with the provided sanitizing wipes when judged necessary. This includes benches, machines, weights, and any surfaces the member has come into contact with

  • Personal Hygiene: Members are encouraged to maintain high personal hygiene standards while using the gym. Strong odors, excessive cologne or perfume, and bare feet (except in designated areas) are discouraged for the comfort of all members.

  • Restroom and Shower Facilities: Members are expected to keep restrooms and showers clean and tidy. Staff should be informed of any maintenance issues promptly.

3.4 Health Considerations

  • Medical Clearance: It is the responsibility of the Member to seek medical advice before engaging in a new fitness program. Montreal Powerhouse recommends that members with any medical conditions or health concerns consult a physician before beginning strength training or powerlifting activities.

  • Illness: Members who are unwell, especially with symptoms such as fever, cough, or shortness of breath, are asked to refrain from visiting the gym until they have recovered.

  • Injury Prevention: Members should only perform exercises and use equipment that they are familiar with and confident in using safely. If in doubt, members are encouraged to consult gym staff for assistance or training guidance.

3.5 Acknowledgment of Health and Safety Policies

By signing this agreement, the Member acknowledges their understanding of the Health and Safety Policies outlined above and agrees to abide by these guidelines while using the facilities at Montreal Powerhouse.

4. Membership Cancellations, Freezes, and Refunds

Montreal Powerhouse offers flexible options for cancellations, freezes, and refunds to accommodate members’ needs. Members agree to the following terms:

4.1 Membership Cancellation

  • Notice Period: To cancel an annual membership, members must submit a written cancellation request at least 14 days before the desired termination date. The monthly membership can be cancelled at any time. Cancellation requests can be submitted via email to info@montrealpowerhouse.com or in person at the gym.

  • Early Termination Fee: Annual Memberships can be canceled without penalties before 1/10 of the contracted term (37 days).  For annual memberships canceled after this period and before the end of the contracted term, an early termination fee of 50% of the total amount due on the remaining time of the contract may apply unless the cancellation is due to medical reasons (see Section 4.2).

  • Annual Memberships Paid in Full: For members who paid for an annual membership in full upfront, a prorated refund will be issued for the unused portion of the membership, less any applicable fees, including the early termination fee, provided the cancellation notice has been given as required.

  • Annual Memberships Paid Monthly: For members on an annual contract who pay monthly, no prorated refund will be issued. However, all future monthly payments will be canceled, effective at the end of the 30-day notice period, after deducting the early termination fee if the membership is canceled before the term ends.

  • Monthly Memberships: Monthly memberships are recurring and renew every month. A monthly membership may be canceled at any time, and the member will retain access to the gym until the end of the current billing period.

4.2 Medical Cancellations

  • Medical Conditions: Members who are unable to use the gym due to a medical condition may request cancellation without penalty. A valid doctor’s note must be provided, stating the reason and duration of the condition. In such cases, the annual membership fee may be refunded on a prorated basis.

4.3 Membership Freeze Policy

  • Freeze Options: Members may freeze their membership for a minimum of 1 month and a maximum of 3 months per year. During the freeze period, members will not be charged, and no gym access will be allowed.

  • Medical Freeze: Members with a medical condition that restricts gym usage may request a freeze for the necessary period with a doctor’s note.

4.4 Refunds

  • Non-Refundable Fees: Registration fees, administrative fees, and any other one-time fees are non-refundable, except in cases where Montreal Powerhouse has specifically agreed otherwise.


5. Legal Details

This section outlines the legal agreements and responsibilities associated with your membership at Montreal Powerhouse.

5.1 Liability Waiver and Indemnification

The Member agrees to waive any claims or rights to compensation in case of injury or accident while using the gym facilities. The Member also agrees to indemnify and hold harmless Montreal Powerhouse from any third-party claims resulting from actions by the Member.

5.2 Governing Law

This agreement is governed by the laws of Quebec. Any legal disputes arising from this contract will be settled in the appropriate legal jurisdiction within the province of Quebec.

5.3 Severability

If any provision of this contract is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

5.4 Entire Agreement

This agreement represents the entire understanding between the Member and Montreal Powerhouse regarding gym membership. It supersedes any prior written or verbal agreements.

5.5 Amendments

Montreal Powerhouse reserves the right to modify or amend this agreement at any time. Members will be notified of any changes in advance.

5.6 Termination of Membership by Montreal Powerhouse

Montreal Powerhouse reserves the right to terminate any membership if it determines, at its sole discretion, that such termination is necessary to maintain the safety, integrity, or overall experience of its members, staff, or facilities. Grounds for termination may include, but are not limited to, violations of the gym’s rules and code of conduct, disruptive or unsafe behavior, or circumstances that Montreal Powerhouse deems incompatible with its values or operations.

In the event of termination, the affected member will receive written notice and, where applicable, a refund of any prepaid membership fees prorated for the unused portion of the membership term, excluding non-refundable fees. This policy is intended to ensure a respectful and professional environment for all and is not exercised arbitrarily.

5.7 Acknowledgment of Understanding

By signing this agreement, the Member acknowledges they have read, understood, and agreed to all terms and conditions set forth in this Membership Agreement.
